Terms of Service

1. About NightTales

NightTales is a community publishing platform for horror fiction operated under the Saboreq brand. The service allows visitors to discover stories and registered users to publish stories, upload images, create profiles, follow authors, save stories, react, comment, organise series, and use other community features.

2. Eligibility and accounts

You must be at least 16 years old, or the minimum age required in your country to use an online service without parental consent. If you are under the age of legal majority where you live, you confirm that you have any consent required by law.

You must provide accurate account information, keep your credentials secure, and promptly tell us if you believe your account has been compromised. You are responsible for activity performed through your account unless applicable law provides otherwise.

Usernames may not impersonate another person, NightTales staff, or an organisation in a misleading way. We may reserve or change usernames where reasonably necessary to prevent impersonation, abuse, infringement, or confusion.

3. Your stories and other content

You retain ownership of content you submit to NightTales. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display, transmit, and technically process that content only as reasonably necessary to operate, improve, secure, and promote NightTales and to make your published content available to other users.

You must have the rights and permissions needed for everything you publish, including text, images, names, trademarks, and AI-generated or AI-assisted material. You may not upload content that infringes intellectual-property, privacy, publicity, or other rights.

Deleting content removes it from normal public availability, although copies may remain temporarily in backups, caches, security records, or records we are legally required to retain.

4. AI disclosure

NightTales supports human-written, AI-assisted, and AI-generated fiction. Authors are expected to use the available disclosure label accurately. We may correct, remove, or restrict misleading labels where needed to protect readers or platform integrity.

5. Horror, mature content, and prohibited content

Horror fiction may include frightening or mature themes. Authors must choose an appropriate content rating and use warnings where reasonably necessary. Graphic stories may receive reduced distribution, advertising restrictions, or additional review.

You may not use NightTales to publish illegal content; sexual content involving minors; credible threats; instructions intended to facilitate serious wrongdoing; doxxing or non-consensual disclosure of sensitive personal information; malware or phishing; fraudulent impersonation; spam; or content that materially infringes another person's rights.

6. Community features and moderation

Users can report stories, comments, and profiles. We may investigate reports and may remove content, limit distribution, disable monetisation or features, suspend accounts, or preserve relevant records when reasonably necessary to enforce these Terms, protect users, comply with law, or respond to valid legal requests.

Moderation decisions may involve automated signals and human review. If a moderation action was made in error, you may contact us and provide relevant context.

7. Creator features

Free authors receive the standard NightTales reading design. Where Creator features are offered, an active paid entitlement may unlock controlled story customisation such as colours, typography, cover treatments, dividers, and atmosphere effects. NightTales does not permit arbitrary user-supplied JavaScript, HTML, or CSS through the story designer.

We may add, improve, replace, or retire individual features over time. If a change materially affects an active paid service, we will handle it in accordance with applicable consumer law.

8. Payments, subscriptions, and renewals

Where paid features are offered, checkout will show the applicable price, billing interval, taxes, renewal terms, and any trial or promotional conditions before you purchase. Payments are processed by Paddle as Merchant of Record, so Paddle's checkout and buyer terms also apply to transactions it processes.

Recurring subscriptions continue until cancelled. Cancelling prevents future renewal but does not automatically create a refund for a period that has already begun. Refund and withdrawal rules are explained in our Refund & Cancellation Policy.

9. Service availability

We work to keep NightTales available and secure, but internet services can experience maintenance, outages, bugs, or third-party failures. We do not promise uninterrupted availability. Nothing in these Terms excludes statutory rights that cannot legally be excluded, including mandatory rights relating to defective digital services.

10. Suspension and termination

You may stop using NightTales at any time. We may restrict or terminate access where reasonably necessary because of serious or repeated violations of these Terms, security threats, fraud, chargeback abuse, legal requirements, or conduct that materially harms the service or its users.

11. Liability

To the maximum extent permitted by law, NightTales is not responsible for user-generated content or for indirect losses that were not reasonably foreseeable. These limitations do not apply where liability cannot legally be limited, including liability arising from intentional misconduct or mandatory consumer protections.

12. Governing law

These Terms are governed by Polish law, without depriving consumers of mandatory protections available under the law of their country of residence. Disputes may be brought before any court that has jurisdiction under applicable consumer and civil-procedure rules.

13. Changes to these Terms

We may update these Terms when the service, law, or our business practices change. Material changes will be communicated in a reasonable manner. The effective date at the top of this page identifies the current version.
